One of the health professional areas that raises the most legal-legal doubts is the care context of emergencies and out-of-hospital emergencies, and in other areas of emergency care. This academic action aims to provide healthcare professionals with legal tools that favor legal comfort in their professional practice. Furthermore, an essential competence / responsibility of healthcare teams is their position as guarantor of the life and physical integrity of patients and users. The special legal-assistance ecosystem of emergency care generates dynamics of "fear" that favors not identifying what is relevant in many emergency and emergency assistance events.

From the National School of Health, this course is proposed within its training strategy for health professionals of the SNS so that this legal knowledge is integrated into professional practice and incorporated into the protocols and professional guides for action. An online course that will present legal content adapted to a health profile.

This edition incorporates a specific module of the legal instruments for the management of Covid-19.

The essential objectives include:

  1. Analyze the basic aspects of the organizational model of the emergency and out-of-hospital emergency system.
  2. Know the nature and dynamics of criminal and property liability.
  3. Study the competence mechanics of the healthcare team.
  4. Analyze the legal variables in emergencies and out-of-hospital emergencies.
  5. Identify the basic regulations linked to the legal management of Covid-19.

The contents and teaching dynamics will be located in the Virtual Classroom of the Carlos III Health Institute.

Important: the basic aspects will be studied, and the legal content will be adapted to the profile of health professionals.

  1. Rights of patients and users in care in emergencies and health emergencies. Right to information, informed consent, privacy and confidentiality of health data.
  2. Analysis of the regulatory framework of the State of Alarm and other regulations related to the Covid-19 health crisis. Law 2/2021 of new normality (health emergency).
  3. Criminal responsibility and criminal procedure. Relevant criminal figures in emergencies and emergencies. Special study on the crime of omission of the duty to help. The legal responsibility of the healthcare team. Doctor-Nurse-TES. Assistance team in hospital emergencies.
  4. The patrimonial responsibility of the regional health services for the actions of the teams and devices for emergencies and out-of-hospital emergencies. Bad and good functioning of the service as a criterion for attributing coordination errors.
  5. The power of the company to organize health services. Right to configure services, resources and equipment. The principle of enforceability and presumption of validity of decisions.
  6. Media, social networks and news about professional actions in the field of emergencies and out-of-hospital emergencies. Right of rectification, Right to Honor and the image of the healthcare worker.

The training action takes place in the virtual campus of professionals of the Carlos III Health Institute (National School of Health). It is a totally online course. ENROLLED STUDENTS WILL RECEIVE A COMPREHENSIVE ACADEMIC GUIDE ON THE GLOBAL DEVELOPMENT OF THE COURSE.

The student on said platform will find in each of the Modules the following academic structure (not exhaustive)

  • Video-Lessons that develop the teaching content proposed in the Module. Mandatory viewing.
  • A mini-theme and / or reference documents that develop the basic teaching content. Mandatory
  • A Forum of Teaching Doubts about the contents of the Module.

Students will be in a position to obtain the accrediting Diploma if they pass the test exam (50 questions with three answer options). It will be held November 30, 2021 (the schedule will be informed in advance and also of the academic conditions associated with the exam).
